Email & SMS Communication Policy

CAN-SPAM & TCPA Compliance

Bella Caché Wellness is committed to communicating with our community in a lawful, respectful, and transparent manner. This policy describes how we manage email and SMS communications in compliance with the CAN-SPAM Act (15 U.S.C. 7701 et seq.) and the Telephone Consumer Protection Act (TCPA, 47 U.S.C. 227).

Part I: Email Communications (CAN-SPAM Act)

1. Honest Sender Information

All marketing emails sent by Bella Caché Wellness will:

  • Clearly identify Bella Caché Wellness as the sender in the "From" name and email address
  • Use Info@mybellacache.com or an authorized sending address
  • Never use deceptive or misleading header information

2. Honest Subject Lines

Email subject lines will accurately reflect the content of the message. We will never use misleading, deceptive, or false subject lines to prompt opens.

3. Identification as Advertisement

Where required, promotional emails will be clearly identified as advertisements or marketing communications.

4. Physical Address

All marketing emails will include a valid physical postal address for Bella Caché Wellness, as required by the CAN-SPAM Act.

5. Opt-Out Mechanism

Every marketing email will include a clear and easy method to opt out of future emails, such as an "Unsubscribe" link. Opt-out requests will be honored within 10 business days, and we will not send additional marketing emails after receipt of a valid opt-out request.

6. Third-Party Senders

If we use a third-party email service to send marketing communications on our behalf, we maintain compliance responsibility for those communications.

Part II: SMS/Text Message Communications (TCPA)

1. Express Written Consent

Bella Caché Wellness will only send marketing text messages to individuals who have provided express written consent to receive SMS communications. Consent may be obtained through:

  • An opt-in form on our website
  • A keyword opt-in via text message
  • A signed paper or electronic form

Consent to receive SMS messages is never a condition of purchase.

2. Opt-In Disclosure

At the point of opt-in, we will clearly disclose:

  • The identity of the sender (Bella Caché Wellness)
  • The nature of messages to be sent (e.g., promotions, wellness tips, appointment reminders)
  • Estimated message frequency
  • That message and data rates may apply
  • How to opt out (reply STOP)
  • How to get help (reply HELP or contact Info@mybellacache.com)

3. Opt-Out Process

Recipients may opt out of SMS messages at any time by replying STOP to any text message. Upon receipt of a STOP request, we will send a final confirmation message and immediately remove the individual from future SMS marketing campaigns.

4. Help Instructions

Recipients may reply HELP at any time to receive assistance. We will respond with our business name and contact information.

5. No Sharing of SMS Data

We do not share, sell, or transfer SMS opt-in data or phone numbers to third parties for their marketing purposes.

6. Sending Hours

We will not send marketing SMS messages before 8:00 AM or after 9:00 PM in the recipient's local time zone, in accordance with TCPA requirements.

7. Record Keeping

We maintain records of SMS opt-in consent for a minimum of four (4) years, as recommended by TCPA compliance best practices.
